Terms & Condition

1. GENERAL AGREEMENT

By purchasing products, trading in devices, requesting repairs, or leaving a device with eMobile, the customer acknowledges and agrees to be bound by these Terms & Conditions. These terms apply to all transactions, whether verbal, written, online, or in-store.

2. ELECTRONIC DEVICE SALES & LIMITED RETURNS

All electronic devices are sold AS-IS unless otherwise stated in writing. Returns are permitted only if an undisclosed pre-existing defect existed at the time of sale and is reported within forty-eight (48) hours of purchase. Devices must be returned in original condition without physical damage, liquid damage, tampering, software modification, or misuse. We reserve sole discretion to inspect, diagnose, and determine eligibility. Buyer’s remorse, battery performance, cosmetic wear, compatibility issues, software preferences, or network issues do not qualify. Approved resolutions may include repair, replacement, or store credit. Cash refunds are not guaranteed.

3. ACCESSORIES – FINAL SALE

All accessories including but not limited to cases, chargers, cables, adapters, headphones, screen protectors, and power banks are FINAL SALE. No refunds or exchanges under any circumstances.

4. USED, RENEWED & PRE-OWNED DEVICES

Used, renewed, refurbished, and pre-owned devices may show signs of prior use. Cosmetic condition, internal components, battery health, water resistance, and longevity are not guaranteed. Manufacturer warranties may not apply. Only undisclosed pre-existing defects reported within 48 hours may be considered.

5. REPAIR SERVICES – ASSUMPTION OF RISK

The customer understands that electronic repairs carry inherent risks including but not limited to data loss, further component failure, loss of water resistance, cosmetic damage, or device malfunction. Pre-existing damage may worsen during repair. We are not responsible for data loss under any circumstances. Customers are solely responsible for backing up all data prior to repair. Biometric features such as Face ID, Touch ID, fingerprint scanners, cameras, speakers, microphones, displays, or sensors may cease functioning after repair.

6. 90-DAY LIMITED REPAIR WARRANTY

eMobile provides a ninety (90) day limited warranty on parts installed and labor performed. This warranty covers only defects directly related to the original repair. This warranty does not cover physical damage, liquid exposure, software issues, firmware updates, battery degradation, misuse, neglect, accidental damage, unauthorized repairs, or unrelated failures. Warranty applies only to the original customer and is non-transferable.

7. SOFTWARE, DATA & SECURITY DISCLAIMER

We do not guarantee data preservation, software functionality, operating system updates, application compatibility, or device security. We are not responsible for lost, corrupted, or compromised data, accounts, passwords, or personal information.

8. CARRIER, NETWORK & ACTIVATION DISCLAIMER

We make no guarantees regarding carrier compatibility, coverage, signal quality, data speeds, ESN/IMEI status, or network performance. Activation of a device constitutes acceptance of the device. Carrier issues are not grounds for return.


9. TRADE-INS & BUYBACKS

All trade-in values are final once accepted. Devices surrendered become property of eMobile immediately. No reversals, refunds, or additional compensation will be provided after completion.

10. UNCLAIMED DEVICES

Devices not claimed within thirty (30) days of service completion may be considered abandoned. Abandoned devices may be sold, recycled, or disposed of to recover costs. Storage fees may apply. We are not responsible for loss after the abandonment period.

11. PAYMENTS, CHARGEBACKS & FRAUD

Fraudulent chargebacks will be disputed using receipts, IMEI records, repair documentation, and video surveillance. Customers engaging in fraud or abuse may be permanently refused service.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law, eMobile shall not be liable for any indirect, incidental, special, or consequential damages. Total liability shall not exceed the amount paid for the product or service giving rise to the claim.

13. INDEMNIFICATION

Customer agrees to indemnify and hold harmless eMobile, its owners, employees, and agents from any claims, damages, losses, or expenses arising from customer misuse, negligence, or violation of these terms.

14. RIGHT TO REFUSE SERVICE

We reserve the right to refuse service to any individual for abusive behavior, suspected fraud, or violation of store policies.

15. GOVERNING LAW & SEVERABILITY

These Terms & Conditions are governed by the laws of the State of Illinois. If any provision is found unenforceable, remaining provisions shall remain in full force and effect.

16. ACCEPTANCE OF TERMS

Completion of any transaction or repair constitutes acknowledgment and acceptance of these Terms & Conditions.
